Industrial Accident Claim

Industrial Accident: Whilst at work on 23 March 1999, the claimant was carrying a car canopy from one workstation to another, when he tripped over some pipes.
The claimant sustained injury and brought an action against the defendant alleging that it was in breach of its health and safety standards.


 

Liability disputed.

Injuries: The claimant ruptured his anterior cruciate ligament and suffered a bucket handle tear of his meniscus.


 

Effects: The claimant underwent an arthroscopy to repair his meniscus, following which he was off work for four weeks, having to keep his knee elevated. Future surgery was also necessary to replace his anterior cruciate ligament. He was not able to work without wearing a knee brace and he was unable to play any sport or play with his children.

Ligament Injury Compensation Award

Prognosis: There was a high risk of degenerative changes as the claimant got older, however he would have full amenity up until that point.


Court Award: £19,325.17 total damages.


Breakdown of General Damages: Pain, suffering and loss of amenity: £11,000; Future loss of earnings: £2,863.30; Future care: £250; Future gardening help: £50.


Breakdown of Special Damages: £7,741.30; Past loss of earnings: £200; Past gardening and DIY costs: £200; Past cost of private operation: £3,800; Travel expenses: £18; Medical expenses: £40.


Background to damages: An award of £583.87 was also given for interest accrued.


The claimant was found to have some previously sustained damage to his anterior cruciate ligament seven years prior to the accident. However, as he was asymptomatic at the time of the index accident, no discount was made to the general damages to reflect this underlying injury.
