Permanent Scarring Claim
The claimant, an 81-year-old woman, received £4,500 for the laceration to her right knee sustained in a road traffic accident in December 2001. The claimant suffered from permanent scarring and impaired mobility as well as an exacerbation of a pre-existing osteo-arthritic condition of her knee joint.

Road Traffic Accident: On 3 December 2001, the claimant was a passenger on a bus, when the driver of the bus braked the vehicle suddenly, causing her to fall to the floor.
The claimant sustained injury and brought an action against the defendant alleging that its employee was negligent in his driving, which caused the accident.
Liability disputed.
Lack Of Mobility Claim
Injuries:The claimant sustained a laceration to her right knee in the accident.
Effects:The claimant required sutures to her right knee and was left with a permanent scar which measured one-and-a-half inches. She received osteopathic treatment for her injuries and suffered from permanent residual pain.
The claimant had difficulty climbing stairs and suffered from pain when walking any distance. As a consequence, the claimant had to move from her first floor flat to a warden controlled flat with a lift. The claimant also suffered from exacerbation of a pre-existing osteo-arthritic condition of her knee joint by approximately two to three years.
Prognosis: The claimant would continue to suffer from pain in her right ankle and leg, and her previously asymptomatic knee-joint condition became symptomatic due to the contact type injury.
Out of Court Settlement: £4,500 total damages.

Initially, the claimant conducted her claim against the defendant through the Citizen's Advice Bureau. On 2 August 2002, the defendant made an offer in full and final settlement of the claim of £1,500 in open correspondence, but this was rejected. The claimant then instructed solicitors and the claim was settled for the above sum on 17 February 2004.
